DEFINATION OF WAGES

"Wages" include various types of remuneration payable under any awards, settlement between parties or orders, as well as overtime work, holidays, leave periods, and additional remuneration payable under terms of employment.

THE ACT APPLIES TO
  1. Persons in factories or industries
  2. Inalienable

RESPONSIBILITIES FOR OF PAYMENTS

  1. The manager is responsible. In the case of an industrial establishment, both manager or contractor are jointly responsible.
  2. Fixed wage periods must be established.
  3. Wages must be paid on a working day within 7 days of the end of the wage period. If the number of employees is 1,000 or more, the payment must be made within 10 days.
  4. Payments in kind are not allowed.

DOES NOT INCLUDE

  1. Bonuses not included in regular remuneration.
  2. The value of certain amenities, such as house accommodation, light, water, medical attendance, or other services if specified by the State Government.
  3. Employer contributions to PF including accrued interest.
  4. Traveling allowances or concessions.
  5. Sums paid to cover special employment-related expenses.
  6. Gratuity.

COMPLAINTS FOR DEDUCTION OR DELAY IN WAGE PAYMENT CAN BE MADE BY

  1. Submitting application within one year to Authority appointed by the State Government.
  2. An Inspector on behalf of the employed person.

The Authority can order the payment of delayed wages or refund of illegal deductions

APPEAL AGAINST AUTHORITY

  1. Can be made within 30 days.
  2. An employed person, legal practitioner, official of a registered trade union can also file an appeal.

PUNISHMENT FOR BREACH

  1. Delaying wage payment, or
  2. Making unauthorized deductions may result in a fine of up to Rs. 2000, but only if prosecuted with the sanction of the State Government or an authorized officer

FINES AND DEDUCTIONS

Penalties can result in loss of wages while Deductions & Fines can only be imposed for specific acts approved by authorities.

Deductions can be made for:

  1. Absence
  2. Damage or loss
  3. Recovering advances or adjusting overpayments
  4. Contributions to PF, cooperative societies, or postal insurance
  5. Life insurance premiums or the purchase of government securities

The Authority can order the payment of delayed wages or refund of illegal deductions
